First and foremost - the audio you hear from the policeman in this clip is wrong. It’s not illegal under Florida law - even under the revised statute they had passed targeting AI-generated VCP.
Also, he wasn’t arrested for that - he basically uploaded actual CSAM onto Kik, who then reported him via the Cybertipline. They had the material his account was recorded having sent, but he didn’t have those specific images on his person, only CGI and drawings. So they’re trying to ‘get’ him using Florida’s old plain-as-day obscenity statute.
But they’re trying him via a statute which proscribes mere possession, which cannot be made a crime per the SCOTUS (an argument which was accepted at the federal level and on the state level in Indiana).
If his legal counsel does their job right, the case will wind up being dismissed.
