"Notice" principle

This thread is for comments on the Notice principle that will form part of Prostasia Foundation’s draft Best Practice Principles for Sexual Content Moderation and Child Protection. Please consult that master thread for background information.

Here is the current text, to be used as a starting point:

Users should be notified when their content is added to a hash database or blocklist, or is subject to context-based restrictions.

Please post your comments and suggestions below.

More community input is needed on this principle. In this NYT article, Tumblr is criticized for giving people notice that their images had been referred to authorities. However Tumblr has done nothing unusual here; other Internet companies also inform their users if they are under investigation by the government, unless they are legally prohibited from doing so.

So I’m suggesting we reword this just slightly to:

Users should be notified when their content is added to a hash database or blocklist, or is subject to context-based restrictions, unless such notification would be prohibited by law.
