I think there need to be clearer guidelines on what is or is not CP / CSAM / CSEM as opposed to art. I suspect a number of teens who have been prosecuted for nude selfies are probably in this category as well.
Maybe we need to inform teens what is legal and what is not. I am not suggesting the sexting should be encouraged, but let’s face it, they are going to do this no matter what they are told. If young people stayed within known guidelines, all they would have to worry about is being embarrassed in the future and not having a felony conviction and sex offender listing.
This type of thing is pathetic. It’s the mind of the offended viewer who’s obsessed with sex and twisted. To get so morally outraged by a nude photo can only mean they were triggered and having deviant, sexual thoughts. To then claim to "be committed to protecting the most vulnerable members of society, our children.” What a ruse to make themselves look so wonderful! While THEY’RE the ones having indecent thoughts!
How do they shower and get dressed in the morning?? Looking in the mirror must be a frightening experience to them! How do you raise children without changing diapers for the first few years? Or bathe and dress them when they’re little? This is the kind of crap that triggers me to want to act out violently on their person! It’s your typical religious, hypocrite behavior!
And this religious undercurrent that dictates laws forcing us to live in this Puritanical minded society full of prudish facists! Always trying to mandate everyone’s thoughts. It’s so repugnant!! This is just one more case of moral panic and outcries of puritanical zealots!
I don’t get how people keep messing this up. Just look at the definition:
CSAM: Child sexual abuse material
CSAM: Child sexual exploitation material
You can’t have these without 1- A child, 2- Sexual abuse and 3- Exploitation.
That’s why fictional CSAM/CSEM doesn’t exist. You can’t have CSAM/CSEM without these 3 things listed.
So how’s that sexual abuse or exploitation if these teens aren’t getting exploited or sexually abused. I also support the separation between “Teen sexual exploitation material” with CSAM, since for me they are clearly different and hold different moral weigh and depending of the age of consent in your area a teenager as young as 14 can consent legally. So putting it on the same level and charges a 14 year old sending nudes to a 15 year old with a man who is actually going to the dark web seeing pictures of abused little children or even paying for it is insane imo.
I agree that this is ridiculous, but while the age of consent may allow sexual activity with a 14 year old under certain circumstances, Federal law says CP (that is how the law is written) applies to anyone under the age of 18. Therefore, it would be helpful to better define in an objective way, what is or is not legal. Lewd and lascivious is a very subjective standard. Nude selfies weren’t a thing when I was a teen, so I don’t know what kids are sending these days. My assumption is that a girl who is persuaded to send a nude is not likely to go all porn star. She will just send a simple nude. Which would not be illegal, IMO. Boys, on the other hand, are likely to send a sext with them “at attention and saluting”, since they are usually proud of that ability. As far as I know, that would definitely be illegal.
I don’t encourage sexting either because it poses privacy risks but persecuting minors for engaging in it is just abhorrent, especially since it’s cases where by law they can have sex but not film it which is paradoxical
There’s also the absurd edge case where, if you apply CP laws literally, a minor could be convicted or investigated for owning photos of himself
Yeah of course laws on such a thing would be inherently ambiguous but the way they are written is just so bad, they need more nuance
Images of naked minors are inherently problematic, since the law requires the nudes to be sexual in nature, which can be highly subjective
One of the good things that are coming in a new EU regulation is that every member state is forced to decriminalize sexting between peers and the possession of images depicting yourself.
Yeah that’s something everyone knew was stupid about the way the laws were written but didn’t change them because they didn’t wanna be seen as “legalizing child pornography”
When the UN cybercrime treaty proposed for states to add that as a (non obligatory, no less!) amendment for states to adopt you had a whole bunch of organisations rioting that they were “legalizing child pornography”
The cybercrime treaty as a whole is a bad, but for different reasons. That and the art and medical use exemptions were the only good things (if only they weren’t optional)
Hell, international organisations that deal with CSAM have to step in and state that the minors themselves shouldn’t be criminalized because the laws are so vague
Exemption on art is all thanks to Japan, they were described by another nation as very adamant to keeping it legal. That was also one of the reasons why it took so long, coupled with other nations trying to include a ban on homosexual depictions.
Regarding the “legalizing child pornography” thing. I also saw these claims being made with petitions coming up reaching half a million signatures, because the Cybercrime convention included said exemption on fictional content. It is honestly insane what lengths people go to just to punish and jail others over emotions alone. Really makes you think.
